1. Agreement to Terms

By accessing or using the heyTrace mobile applications (Trace app), heyTrace platform, Trace hardware, and services provided by VICINUS TECH PRIVATE LIMITED ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use our services.

2. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of VICINUS TECH PRIVATE LIMITED. This includes:

• The "heyTrace" and "Trace" brand identities and hardware design.
• The EndlessRiver software ecosystem and heyTrace OS (Trace OS).
• Proprietary machine learning models and "Aesthetic Intelligence" algorithms.
• Text, graphics, logos, and audiovisual materials.

3. User Representations

By using the Service, you represent and warrant that you are at least 18 years of age and that you will use heyTrace (Trace) in compliance with all applicable local, state, and international laws, including privacy and surveillance regulations.

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Unauthorized recording in sensitive areas where prohibited by law.
• Reverse engineering or tampering with the heyTrace smart glasses' (Trace) firmware.
• Using the platform for any illegal tracking or harassment.
• Attempting to bypass any security or data isolation features.

5. Limitation of Liability

In no event shall VICINUS TECH PRIVATE LIMITED be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, or personal injury resulting from the use or inability to use the services.
